The court case is going ahead, there is an argument over TEXT messages. Does a text message constitute and agreement!!!!!!

Heerenveen sent a text message to AZ (Directors I suppose) agreeing the deal although no contract has been signed between the two clubs.

It's all a bit crazy. The player is said to be refusing to play for AZ regardless of what happens.

It's going to be messy I think?

None of the official documents between the two clubs are signed, but the player was given permission to talk once a verbal agreement had been reached between the two clubs, Alves signed a contract and apparently there are text messages between the two clubs confirming the agreement. BUT nothing official ref the transfer of registration has been signed.

I guess in England it would be like Boro agreeing to sign Matty Taylor from Pompey, Boro sending Pompey a fax, them giving us permission to speak to the player, him coming for a medical, agreeing personal terms, signing his contract only for Pompey to not release his registration - I don't know what would happen in those circumstances, is there any test case in England on this?

i am no epert but i would think its all down to if the club, Herenveen, agreed to release him - Alves could sign anything but its the club that hold his registration and until they agree and sign he doesn't go anywhere and still belongs to them.

this whole thing just makes AZ look like desperate losers mind

yes contracts can be made by text, but the fact is, is that even though a text may agree a deal it is not to be seen as the whole and complete contract, and therefore cannot be legally binding.

heerenveen will argue that the contract can only be seen as complete and binding when the release documents are signed and forwarded to the FA, as is typical for transfers, which on the facts has not been done. Making alves Heerenveens player

AZ will argue that the contract was completed when the deal between alves and AZ was agreed and the transfer of the player was agreed between AZ and heerenveen, and that heerenveen are under an obligation under the terms of the contract to release the player. making him AZ's player.

its up to the arbitration panel to decide how dutch law stands.

It's really not very exciting Quahog. On deadline day in 1995 we signed Phil Whelan from Ipswich Town. Somebody didn't get the registration to the FA in time so he couldn't play for us until the following season.

I've never seen a actual story saying Lamb was personally stood by the fax machine at two minutes to midnight going "how do you work this thing", but that's how it has entered legend.

Whelan wasn't worth waiting for.

The plot thickens! AZ have paid into the account of the Dutch FA 18m on January 5th, Heerenveen have refused to accept the money, it's all crazy.

The case in on going now and will be settled any time in the next two hours, although there is an appeal procedure so today is by no means then end.

A compromise needs to be reached between the two Dutch clubs and the buying club.

AZ are looking to be in a strong position according to my journo pal in Holland.

even if the deal goes hereveens way there is the appeal(next week?) then if thats lost it will go UEFA and then the inevitable appeal of that. Then theres the work permit stuff, and thats only if no one else out bids us in the mean time which is a certain not a possibility.

Very miniscule chance of this being sorted this january, unless AZ, Herenveen, Boro, The Dutch FA, and Uefa agree to let him sign on Loan to us for the remainder of the season while it is sorted out.

If AZ win, then what will happen is that Heerenveen will have to accept the agreed offer from AZ.

Then Boro will obviously offer AZ the exact same amount they agreed with Heerenveen (since the player's value will still be the same).

By all accounts, AZ will walk away with a profit from the difference of several million Euros.

The only advantage of Heerenveen winning the case is that the deal is already agreed with them, so it is more certain, but since the player does not want to play in Holland, then AZ will be forced to sell him anyway.

This is somewhat different to that scenario.

As soon as you take the goods to the checkout you indicate your intent to contract to purchase the goods. You can still refuse to buy the goods right up to the point of handing over the cash. Once you hand over the cash you effectively concluded the deal.

On the other hand, the shopkeeper creates the intent to sell as soon as they place the item on their shelves.

In this case, the text/email messages indicate an intent to sell but I'd be surprised if they constituted a legal agreement.

In other words the Dutch FA may rule in favour of AZ but it doesnt mean the courts will.

Just talked to a friend in Holland that works for a paper for the second time tonight.
He says judge first ruling was that the contract with AZ was valid. However so is his contract with Heerenveen. So he has two contracts. The judge ruled that it makes no difference that his attorney didn't sign.
Secondly he states that it also valid that there was never a request by Alves to Heerenveen to leave so his contract there as his employer was and still is valid. Also that there was never papers filed with the Dutch FA to transfer contract of Alves to AZ. Because of this Heerenveen is saying we have nothing to do with this so leave us out. Trying to cover themselves from compensation claims from AZ.
Alves claimed through his attorney that he didn't turn the request in because he didn't want to go to AZ in the end. Also he wants to play at Boro.

The Judge has to decide what to do now with those facts.

He is in a way, but not officially. In fact, there are presumably more signatures on the contract with Boro than the one between him and AZ. But the one with AZ was created before the one with Boro.

Let's hope Boro get their man at the end of this.

I don't have any sources, but I said yesterday that he can only have one valid contract at anyone time. Until Herenveen have agreed to release there contract, and release his playing registration he is there player.

If both contracts are valid, then surely the original contract will take precedence. It must.

I expect him to sign for us, frmo Herenveen, and either Herenveen will pay part of the fee, maybe 900K euro to AZ or they will fight it out in court between themselves.

It's probably best for AZ to back off, if they don't they could find themselves sued by Alves for breach of human rights (under euro working law directives) and loss of earnings, from his increased Boro contract, that he cannot currently take up.

sounds like, the panel have decided that heerenveen have to sign the release papers under the completed contract, and not that signing the papers would complete the contract. nd so as AZ completed a contract before middllesbrough they have the legal rights to the player, heerenveen would not be in a position to negotiate a contract with boro for a layer they no longer own:(

there is no way he can go and play, for AZ now. In fact it seems unlikely that he wants to play for them.

I still make us favourites to get him, the ruling so far seems nothing more than an agreement that AZ have the right to further investigation. they have a signed contract....but if only one can be in place, and Herenveen still have one then what to do? Surely Herenveens contract, yet to be cancelled takes precedence.

The same thing happened with jarni(i think, the croat that was signed for coventry, then a week later signed for real madrid. Coventry up a couple of hundred grand in the transfer

Surely a text message can't be legally binding. A text from a phone doesn't mean a particular person sent it, it just means that phone sent it - it's difficult to prove a particular person sent it.
I know there are such things as verbal contracts but they can be very difficult to hold-up in court without witnesses.
