Capital Punishment.

With recent events in mind is it time for the return of capital punishment?

Every day we hear of stabbings, shootings, paedos, people torturing toddlers etc.

IMO it would be a slow death

The murder rate is falling and it was already low, despite the hysteria in the press.

The murder rate is much higher in the US even though many states have the death penalty. When you have the Government killing people, it's likely to make people think life is cheap and killing is an appropriate response to bad behaviour. I'd rather people thought life was important and had a horror of killing people.

People only need to study crime figures in countries that use capital punishment to know that it does not work at reducing crime! Although, if your aim is to kill someone then it does but I do believe the aim would be to actually reduce crime which it does not.

Rather than focus on the punishment of such criminals maybe we should try and makesure the crime does not occur at all. By looking at a number of factors including poverty levels, education, economic conditions and the very society we live in. The government and the public are to quick to look at punishment rather than looking at ways to stop crime from occuring in the first place.

There are so many cases in America of people being found to be not guilty AFTER they have been killed after being on death-row for something like 25 years..

So firstly they have served a prison sentence (denying them of any freedom .. some would see that as one punishment) but also a chance to reform in jail (another purpose of prison, some might say), but then they're killed anyway. The case of Stanley 'Tookie' Williams (i think thats what his name was .. involved with the gang 'the crips') was crazy .. with evidence suggesting that he wasn't even guilty!

Why do you only discuss punishment rather than offer any sort of solution to stopping crime from occuring in the first place. You feel a person should be killed because he or she has committed murder although it seems to me you only have one single view of murder not that it can be committed under certain circumstances or how do you 100% prove that person did it The only argument one can give for capital punishment is for someone who has commmited a large amount of murder such as Harold Shipman as it is obvious he did it. You can have your own view but many people disagree and capital punishment will never return to this country and I am thankful for that.

I know a prison officer who had to go into a cell where one prsioner had killed the other prisoner and partly eat him.

I'm for tough sentences, but if you hang someone, you can't bring them back. Probably 20% of convictions are wrong, even ones that seem right you might change today. Ruth Ellis killed her boyfriend for using her and then going with other women behind her back. Repeat Sex offenders should have compulsory chemical treatments, many actually ask for it to stop them.

Prison is already a bad enough punishment for child killers and rapists, in most cells its impossible to get channel 5 on tv, you have to work, only allowed 1 hour a day in the gym, the tips on the pool cues are cack and theres usually never any chalk, queues for the phone in association are a nightmare, when you order a book in the library it takes about 2 weeks to come, and as for the 4 meals a day, lumpy mash and the custard is never sweet enough.

But thats what they deserve for their horrible crimes.

that raises the eternal question about prison is putting criminals in prison meant to rehabilitate them into functioning members of society? or is it about punishing them for the crimes they have committed against that society?

In practice of course it is somewhere between the two but the question is what shade of grey do we draw the line through?

DNA evidence is not the Holy Grail of prosecution. It has flaws. So, added to the fact that it doesn't work as a deterrent, and the fact that emotive considerations rightly have no place in justice (unless you fancy a vigilante-style justice system), you are left with a very shaky argument. The likes of Shipman, West and Huntley are seriously sick individuals who have either committed suicide or have attempted it. For me, even letting them die would give them what they want.

Death is the easy way out.

All the stuff about whether an innocent person is killed is very relevent to this debate as thats why CP was abandoned in this country in the first place.

You only have to look at the states to see that it doesn't work AND that even with the advent of DNA evidence innocent persons have still been executed.

It isn't, but keeping someone on death row costs a hell of a lot more then keeping them in prison.

Extra guards, suicide watch, constant appeals, lawyers cost a hell of a lot you know. I think if you get off your backside and do some research you'll find it isn't cheap. If you think they just turn up with a gun and 'pop a cap' then you're wrong, no legal process, no safety.

Besides now the UK has entered into a number of treaties prohibiting CP as a form of punishment, so deal with it mate, you'll not get what you want in this lifetime.

The whole perverse nature of applying the death penalty is encapsulated in the way that in the US, death row prisoners are on constant suicide watch and are given medical treatment to keep them alive until it is time to execute them. I've even heard of cases where they give prisoners psychotherapy so they don't have to worry about killing someone who is insane. They even use sterilised needles for the lethal injections. For me, that is completely barbaric and archaic. It's more about blood-lust-driven vengeance than justice. It has no place in a modern, civilised society. IMHO.

Experience in the US suggests that executing people is much more expensive than imprisoning them, because of the costs of employing lawyers to go through decades of appeals to avoid mistakes. A surprisingly high percentage of people on death row end up being cleared or pardoned.

The death penalty was scrapped in the UK mainly because of high profile controversial convictions plus the fact that, although a majority of voters were in favour of the death penalty, a majority of voters always seemed to be opposed to specific executions. This is what I remember from the 1950s.

The death penalty also creates problems with juries, as they can be unwilling to convict people if they know they're effectively killing them. Jurors may not want to take that responsibility.

As I said before, I believe it's only a short step from the Government killing people to "he deserves to die and if no-one else will do it..."

BTW "an eye for an eye" is a legal rule to prevent excessive punishments. 3,000 years ago, life was cheap and the Jewish law aimed to limit killing as a punishment. They also had "cities of refuge" which acted like voluntary prisons. As long as you didn't venture outside them, you couldn't be executed.
